Terms of Participation

1. About these terms

These Terms of Participation ("Terms") govern your participation in the Fore Seasons Indoor Golf Tour ("the league"), a recreational indoor golf simulator league operated by Jacob Ferrell ("the host") at his private residence in Kaysville, Utah. By registering, paying the buy-in, or entering the property, you agree to these Terms in full. If you do not agree, do not participate.

These Terms may be updated. The current version is shown at the bottom of this page. Continued participation after updates constitutes agreement to the new version.

2. Assumption of risk

You acknowledge that golf — even on a simulator — and visiting a private residence both involve inherent risks. By participating you voluntarily and knowingly assume all such risks, including but not limited to:

Slipping, tripping, or falling on the host's property, including the lawn, walkways, driveway, fence gate, exterior steps, or any uneven surfaces.

Injury inside the simulator from your own swing, another player's swing, a club, a golf ball (real or rebounding off the screen), the launch monitor, the projector, or any other equipment.

Strain, sprain, repetitive-use injury, or any other injury resulting from the act of swinging a golf club or otherwise participating.

Property loss or damage to clothing, phones, or other personal items brought onto the property.

Weather conditions affecting access to the property, including ice, snow, or rain.

You are responsible for assessing whether your own physical condition makes participation safe for you.

3. Release of liability and indemnification

To the fullest extent permitted by law, you release, waive, and discharge Jacob Ferrell, his household members, and his property from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury — including death — sustained by you while on the property or while participating in any league activity, whether caused by negligence of the host or otherwise.

You agree to indemnify and hold harmless the host and his household from any claim, damage, judgment, settlement, attorneys' fees, or other cost arising from your actions, your guests' actions, or any breach of these Terms.

If any portion of this release is held unenforceable, the remainder remains in full force and effect.

4. Equipment care and damage

The simulator, screen, projector, launch monitor, hitting strip, stance mats, turf, furniture, and all other equipment in and around the shed are private property and expensive to repair or replace.

You agree to treat all equipment with care and to follow any verbal or written instructions from the host. You are financially responsible for any damage you cause through misuse, negligence, horseplay, intoxication, or failure to follow instructions — including (without limitation) screen punctures or tears, projector damage, broken clubs that hit the screen or frame, and damage from dirty or non-compliant golf balls.

5. Clean clubs and clean, logo-free balls

Clubs must be cleaned of dirt, sand, and grass before each round. A club washer is mounted on the exterior of the simulator for this purpose.

Golf balls must be clean and free of any colored ink, logos, or markings. Colored ink transfers onto the screen at simulator spin rates and degrades it permanently. The host reserves the right to refuse use of any ball that does not meet this requirement.

6. Conduct, alcohol, and minors

You agree to conduct yourself respectfully toward the host, his household, and other participants. Unsportsmanlike behavior, excessive noise, harassment, intentional damage, theft, or any conduct the host considers unsafe or disruptive is grounds for immediate removal from the property and the league with no refund.

Alcohol consumption on the property is at your own discretion and your own risk. The host does not provide alcohol. You agree not to drive a vehicle off the property in any condition that violates Utah law. You will not bring or consume any illegal substances on the property.

Anyone under the age of 18 must be accompanied by a parent or legal guardian, who assumes full responsibility for the minor's safety, conduct, and any damage they cause.

7. Tee-time bookings, no-shows, and cancellations

Slots are first-come, first-served via the website. Each slot is a 3-hour window holding up to four players.

If you cannot make a booked slot, please cancel or reschedule by texting the host at least 12 hours in advance so the slot can be released to others. Repeated no-shows or last-minute cancellations may result in removal from the league with no refund.

You are responsible for booking your own rounds within each tournament window. Missed rounds count as unplayed for that tournament.

8. Buy-in and refunds

Buy-in is paid via Venmo to @jacobferrell at the time of registration. Your spot in the league is not confirmed until the host receives the buy-in and approves your join request.

The buy-in is used solely to cover league expenses, including but not limited to: software licensing (SGT and GSPro), tournament prizes, snacks in the simulator, replacement of the hitting strip and stance mat, screen and projector maintenance and repair, and the hole-in-one fund. The host does not retain any of the buy-in as profit.

Refund policy: if you withdraw before the league begins, a full refund will be issued. After the league has started, refunds are at the host's sole discretion. If the league is cancelled before it begins due to insufficient enrollment, all buy-ins will be refunded in full.

9. Recording and photography

The simulator and the property may be monitored by security cameras, including audio. You consent to being recorded while on the property. Recordings may be used for safety, facility maintenance, dispute resolution, and occasional promotional content (e.g. clips of memorable shots posted on the league website or social channels). If you do not want to appear in promotional content, tell the host and reasonable efforts will be made to honor that preference.

10. Personal data

By registering you provide your name, email, and optionally your handicap, GHIN number, and SGT identifiers. This information is stored in the league's private database and is used solely to operate the league (account login, calendar invites, scoring, standings, tournament communications). It is not sold, shared, or used for marketing.

11. Removal and termination

The host reserves the right to deny entry, terminate participation, or remove any person from the league or property at any time, with or without cause and with or without refund, if the host determines in his sole discretion that doing so is necessary for the safety, comfort, or enjoyment of others or the protection of his property.

12. Governing law

These Terms are governed by the laws of the State of Utah. Any dispute arising from these Terms or your participation will be resolved in the state or federal courts located in Davis County, Utah, and you consent to personal jurisdiction there.

By registering, paying the buy-in, or entering the property, you agree to all of the above.
